TERMS AND CONDITIONS

These Terms and Conditions (hereinafter referred to as the "Agreement") are entered into by and between Passport Rush LLC, a limited liability company organized and existing under the laws of the State of Delaware, United States of America, doing business as PassportVisaRush.com (hereinafter referred to as the "Company"), and any individual or entity purchasing or otherwise utilizing the services offered through the Company's website (hereinafter referred to as the "Customer"). By accessing, using, or purchasing any service offered by the Company, the Customer acknowledges that he or she has read, understood, and agrees to be bound by the terms, conditions, and obligations set forth herein.

1. GENERAL PROVISIONS

1.1 The Company operates as a private, third-party document preparation service specializing in assisting customers with the completion and review of passport-related forms and associated documents prior to their submission to official government agencies.

1.2 The Company is not affiliated with, endorsed by, operated, or owned by any governmental entity, including but not limited to the U.S. Department of State, U.S. Passport Services, or any other division of the federal government.

1.3 All materials, forms, and informational content provided by the Company are intended solely for informational and preparatory purposes. Blank passport application forms are publicly available free of charge from official government websites such as travel.state.gov. The Company's services consist exclusively of document preparation, organization, and administrative support.

1.4 The Customer expressly acknowledges that the Company does not process, submit, or file passport applications with any government agency, nor does it guarantee approval or issuance of any passport or document by any governmental authority.

2. SERVICE DESCRIPTION AND PERFORMANCE

2.1 Upon successful payment, the Company shall commence document preparation and related administrative services as ordered by the Customer. Such services include, but are not limited to, digital completion of passport forms, data verification, formatting for compliance, and the electronic delivery of the prepared documents to the Customer for submission.

2.2 All document review and preparation activities are performed manually by staff of the Company to ensure consistency, legibility, and conformity with publicly available application standards.

2.3 Services are deemed fully rendered and completed upon the electronic delivery of the prepared document to the Customer. The Company's obligation terminates at the point of delivery of the digital file.

3. PAYMENT TERMS

3.1 All payments must be made in full and are due at the time the order is placed. Payment is a condition precedent to the commencement of any service.

3.2 By completing payment, the Customer authorizes the Company to begin work immediately and acknowledges that the right to withdraw or request a refund shall be limited as defined herein.

3.3 The Company does not process or store credit card data. Payments are handled through secure, compliant payment processors. The Customer agrees to provide accurate billing information and authorizes the Company to charge the agreed fee for services rendered.

4. SERVICE DELIVERY TIME

4.1 The Company shall make every reasonable effort to complete and deliver the prepared documentation within forty-eight (48) hours following the confirmation of payment, excluding weekends and recognized United States federal holidays.

4.2 The Customer understands that delivery refers to the digital transmission of the completed document to the email address or portal designated during purchase and does not relate in any way to the time required by governmental agencies to process passport applications.

5. REFUNDS AND CANCELLATIONS

5.1 Due to the personalized and immediate nature of document preparation, all payments are final and non-refundable once processing has begun.

5.2 Refunds shall only be granted at the sole discretion of the Company under the following limited circumstances: (a) clear technical error resulting in duplicate billing; (b) verified fraudulent use of payment credentials; or (c) proven duplicate submission by the same Customer within a single transaction period.

5.3 No refunds will be issued for dissatisfaction, misunderstanding of services, changes in personal travel plans, or denial of passport issuance by governmental entities.

5.4 The Customer acknowledges that services commence upon payment, that the Company performs manual labor immediately thereafter, and that refunds cannot be justified once preparation activity begins.

6. CHARGEBACKS AND FRAUDULENT DISPUTES

6.1 The Customer agrees not to file or initiate any credit card chargeback or payment dispute for services properly rendered or in progress.

6.2 If a Customer files a chargeback after documents have been delivered or after the initiation of service, such action shall constitute material breach of this Agreement and may be deemed fraudulent intent.

6.3 In the event of a chargeback or dispute, the Company reserves the right to provide evidence to financial institutions, payment processors, and, when necessary, law enforcement authorities. Evidence may include IP address logs, document metadata, timestamps, customer communications, and digital delivery confirmations.

6.4 The Company retains the right to recover all fees, costs, and damages incurred as a result of unjustified chargebacks, including legal fees and administrative expenses.

7. CUSTOMER RESPONSIBILITIES

7.1 The Customer warrants that all personal information, identification data, and supporting details provided are true, complete, and accurate to the best of the Customer's knowledge.

7.2 The Customer acknowledges that any delay, rejection, or denial of a government-issued passport resulting from inaccurate or incomplete information is solely the Customer's responsibility.

7.3 The Customer agrees to review the prepared documentation upon receipt and verify all information prior to submission to any government authority.

7.4 The Company shall not be held liable for any typographical, factual, or data-entry errors caused by incorrect or incomplete information provided by the Customer.

8. DATA SECURITY AND RETENTION

8.1 The Company collects only the personal data necessary to perform the contracted service.

8.2 The Company does not permanently store or retain personal data once the service is completed and documents are delivered. All collected information is securely deleted following fulfillment.

8.3 The Customer understands that electronic communications may not be entirely free from unauthorized access, and the Customer assumes responsibility for maintaining appropriate device security and data confidentiality.

9. LIMITATION OF LIABILITY

9.1 The Company provides all services on an "as-is" and "as-available" basis, without warranties of any kind, express or implied.

9.2 Under no circumstances shall the Company be held responsible for the approval, processing time, or ultimate issuance of a passport or any related government document.

9.3 The total cumulative liability of the Company for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Customer for the specific transaction from which the claim arises.

9.4 In no event shall the Company, its officers, employees, or agents be liable for indirect, consequential, incidental, or punitive damages, including but not limited to loss of profits, business interruption, or loss of data, arising out of or connected to the use or inability to use our services.

10. INDEPENDENCE FROM GOVERNMENT ENTITIES

10.1 Passport Rush LLC and PassportVisaRush.com are private enterprises. They are not government agencies, nor are they endorsed, authorized, or operated by the United States Government or any of its subdivisions.

10.2 The Customer acknowledges that the same government forms provided through the Company's preparation process can be obtained directly, free of charge, through official channels. The Customer pays solely for the convenience, administrative assistance, and review service provided by the Company.

11. ACCEPTANCE OF TERMS AND 24-HOUR CANCELLATION CLAUSE

11.1 By submitting payment, the Customer expressly consents to the immediate commencement of service.

11.2 The Customer may contact the Company within twenty-four (24) hours of payment only if processing has not yet begun, to request a cancellation. Beyond this period, or once preparation has started, all sales shall be final.

12. FORCE MAJEURE

12.1 The Company shall not be held responsible for any delay or failure to perform obligations under this Agreement resulting from events beyond its reasonable control, including but not limited to acts of God, power outages, strikes, telecommunications failures, system interruptions, or government actions.

13. GOVERNING LAW AND JURISDICTION

13.1 This Agreement shall be governed by, and construed in accordance with, the laws of the State of Delaware, United States of America.

13.2 Any dispute, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts of the State of Delaware.

13.3 The Customer hereby irrevocably submits to such jurisdiction and waives any objection based on venue or forum non conveniens.

14. SEVERABILITY

14.1 If any provision or clause of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. ENTIRE AGREEMENT

15.1 These Terms and Conditions constitute the entire understanding between the Company and the Customer, superseding all prior agreements, understandings, representations, or communications, whether written or oral, relating to the subject matter herein.
